Aims and Limits of Criminal Law

The Kolloquium will discuss some key topics of the criminal law theory on the basis of judicial decisions and scientific papers. Among other things, the aims (protection of legal interests/Rechstgüter, confirmation of norms, etc.) and limits (harm principle, ultima ratio, proportionality, etc.) of criminal law will be discussed. This will be accomplished with pre-session reading of court decisions or academic papers and/or with students’ presentations. These activities will subsequently form the basis of a discussion between all participants of the Kolloquium.

Das Kolloquium wird anhand von Urteilen und wissenschaftlichen Beiträgen zentrale Themen der Strafrechtstheorie besprechen und analysieren. Diskutiert werden u.a. die Zwecke (Rechtsgüterschutz, Normbestätigung usw.) und Grenzen (Harm Principle, Ultima Ratio, Verhältnismäßigkeit usw.) des Strafrechts. Dies geschieht in jeder Sitzung durch vorherige Lektüre von Gerichtsentscheidungen oder wissenschaftlichen Beiträgen und/oder durch die Präsentationen der Studierenden. Auf diese Grundlage erfolgt eine Diskussion zwischen den Teilnehmenden.
